Please read these terms and conditions carefully before using the Hanamura website

You affirm that you are over 18 years of age or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these terms and conditions of use, and to abide by and comply with them.

By accessing, browsing or using the website or any services provided by or referenced in the website, including any Hanamura social accounts in the third party owned social networks, you confirm that you have read, completely understood, agreed and accepted our terms and conditions and the privacy policies. Please read it carefully, and you if do not agree to any of the terms, conditions or privacy policies you should not use the website. We may, in our sole discretion, modify these terms and conditions and the privacy policies at any time. All changes will be effective immediately upon posting on the website and you affirm that you will review these terms, conditions and privacy policies periodically as you should agree and accept any modifications before using the website and any of its services.

Ordering

By placing an order on our website or via telephone you confirm that you are legally capable of entering into binding agreements and that you are at least 18 years old.

Your order is placed immediately when you have successfully paid your order online (“Credit card. Pay online now” Payment method is selected). If you have chosen to pay upon delivery by selecting “Cash” or “Credit card. Pay upon delivery” payment method, your order will be confirmed and placed only after you verify your mobile phone number by replying to our sms or phone call

You can cancel your order at any time before providing your delivery details and clicking the “Order” button. You should understand that by clicking the “Order” button you confirm that you have provided correct and accurate information and agree to pay for the products and services you have selected on our website. We ask you to carefully check the information that you provide, as any incorrect personal details may lead to delays and problems processing your order. We do not accept any responsibility in cases where you have provided incorrect information.

To deliver you the freshest food we always immediately start preparation of your order, therefore we cannot cancel any order that was successfully placed.

We are very focused on serving you the freshest food, so we never hold large stocks of seafood and have them supplied daily. This sometimes can lead to some ingredients being out of stock, so even though we are committed to always having the full menu available, we do not guarantee it. In the case if you have ordered the product that is not available, we will notify you immediately so you can decide if you want to substitute it, deduct the amount from your total order or cancel it.

All our food is prepared from fresh ingredients and served to be consumed within a short period of time. We do not guarantee and accept any responsibility for the quality of food if it is not consumed within 3 hours from the time of your order.

All product photographs are presented for your convenience on the website and actual products may not look exactly the same, as we do not use automated cooking equipment and most of the products are hand-made.

Delivery

All deliveries are free. Each area has minimum order amount to be delivered, which is the total price for your order after any applicable offers and discounts. If your total order amount is less than required for delivery, you can always pick up your order at our restaurant (15/954 North East Road, Modbury, 5092), as there is no minimum order requirements.

You can set a specific time for you delivery, but not less than 90 minutes in advance. We do try our best to deliver your order at the specified time, but as the traffic is out of our control, we do not guarantee that your order will be delivered at an exact time.

Average delivery time is 50 minutes, but it may vary depending on your order, delivery address, traffic conditions and the number of current delivery orders, so please allow delivery time to take up to 90 minutes. If you receive your order after 90 minutes, you can decide if you want to accept it or receive a full refund.

We are committed to providing high quality service, so all our customers receive their orders on time. Furthermore, we provide free delivery, so you only pay for the food you order. In order for us to comply with these two terms we need you to pick up your order as soon as our driver delivers your order and gives you a call to the mobile number that you have provided, so please keep your phone by your side as the driver will only stay for 5 minutes at the address that you have provided. Our driver will only be able to deliver the order to your door if there is available free parking within 100 meters of your delivery address and if there is a free access to your office or home, otherwise you will need to pick up your order from the delivery car, which will be waiting next to the delivery address. We want you to understand that there are other customers just like you who also want to receive their orders as fast as possible, so please don’t keep them waiting.

Once the order is fully ready and meets high quality (law) standards, it will be your obligation to pay for it. In case if you upon delivery you will not receive your order, which includes not answering the provided mobile telephone number or not opening the doors or showing up to pick up your delivered order, within 5 minutes from delivery, we will keep the right to force you to fulfill your obligation.

We deliver orders only within a certain area and we do not take orders for delivering outside those areas.

We always have a right to make you complete your obligation to pay. If you have any unpaid orders you will only be able to place your order after you have paid your previous order.

Pick up orders

You can place a pick up order online or via the phone. You can set a specific time when you will collect it at our restaurant (15/954 North East Road, Modbury, 5092) or you can select an option for us to complete your order as soon as possible. Depending on the time of the day and size of your order it may take anywhere between 10 to 60 minutes for your order to be completed. You may always call us so our friendly staff will advise you about a more specific time.

We strongly advise you to pick up your order as soon as it’s ready. Hanamura will not be responsible for the food quality in case of a delayed collection.

Uncollected orders

Hanamura will always use the best endeavours to fulfill its obligation to prepare your order for your pick up or have it delivered to your address, and if for any reason the order cannot be completed a full refund will be issued if the order was paid in advance. However, if the order is completed and is fully ready for pick up at the restaurant or to be collected at the delivery address, but nobody shows up to pick it up, or doesn’t answer the phone or open the door, the next order for the same phone number or delivery address will not be taken unless the previously uncollected order is fully paid. Hanamura reserves a right to collect the payment for any uncollected order, which was fully completed and timely ready for pick up at specified location (restaurant: 15/954 North East Road, Modbury, 5092 or delivery address).

Price

All our product prices are shown in Australian dollars and are GST inclusive.
Prices are shown on the website “as is” and are subject to change without prior notice. However, these changes will not affect the prices that were already confirmed in your order.

Payments

You can select to pay online using your credit card, or pay upon delivery with cash or your credit card. If you have selected to pay cash, please provide the dollar note amount from which you will require change, so our courier will have it ready. Otherwise we do not guarantee that the change will be available, especially from one hundred dollar notes.

All orders exceeding $100.00 can only be paid in advance online during the checkout.

All credit card payments will be processed for the exact amount of order and you will receive the receipt upon your order delivery. All transactions are processed in Australian dollars. In rare circumstances some transactions may take up to 60 days to be charged and deducted from your account.

All our online payments are handled by a secure third party payment gateway (Commonwealth Bank of Australia) and Hanamura will never store or save your card details.

For the avoidance of doubt, Hanamura will not in any circumstances be liable to you or any third party for any loss or damage you may suffer arising from credit card fraud or identity theft.

Refund policy

It is of utmost importance to us that the quality of our food and services complies with our high standards, therefore if you have any complaints or feedback we would like to hear from you.

In case if you have any complaints about our food or service provided, we will replace it or process a refund.

All refunds will be reimbursed using the same payment method as was used for your purchase. Please note, that some electronic refunds may take up to sixty days to be completed and deposited to your bank account.

Cancellations

You can cancel your order at any time before it’s been confirmed.

You will not be charged for cancelled orders made in accordance with these cancellation provisions.

Any orders cancelled outside these provisions will be charged and no refund is possible.

Hanamura reserves the right to cancel any order before or after confirmation. In this case, you will be notified immediately and a full refund will be processed.

Booking a table

We understand that sometimes plans change, so we always ask that you be respectful to other guests by notifying us if you want to cancel your booking, so we can give your table to someone else.

Your table stays reserved within 15 minutes of the time you specified in the booking. If you are going to be late please give us a call, so we can leave your table.

You can reserve a table online at least 2 hours prior to the time of your booking or you can always call us to find out what times are available. We do not guarantee that we will have a table for the time that you have requested, and in this case we will offer you a different time. Thus, you should always reserve your table in advance.

Your reservation is completed only after you have received a confirmation over the phone.

We always try to have a table ready for the reserved time, but sometimes our guests stay for longer and in this case there could be some wait time. We apologise for any inconvenience.

Intellectual property rights

All material contained on this website is the property of Hanamura and protected by copyright and other intellectual rights under Australian and New Zealand laws and international conventions. Except as permitted by a prior written approval or copyright legislation, none of the material  or any part of these materials may be used, copied, reproduced, published, stored in a retrieval system, altered, transmitted in any form or by any means.

Such material includes, but is not limited to: the text, graphics, html code, java script, flash files, videos, photos, images, concepts.

The trademarks, logos, icons and any other designs used on this website or services provided or referenced by the website, including delivery materials, uniforms, advertising and other custom designed materials, including registered and not registered are the property of Hanamura, affiliates and related entities.  The trademarks must not be used or modified without a written permission of Hanamura, affiliates and related entities.

Hanamura Club card (Currently Unavailable)

A customer who spends $50 or more in the restaurant, including delivery orders, is eligible to receive Hanamura club card.

A customer should provide required information and agree to the terms and conditions by filling out and signing the form in the restaurant or online to receive the card.

Only one card can be used per order to receive or redeem points.

For each dollar spent at Hanamura restaurant, including delivery and pick up orders one point is awarded.

Points are redeemed at the rate of 20 points for 1 dollar, which can only be used for paying for dine-in or pick up order at Hanamura restaurant. Points cannot be exchanged for money.

Points can be redeemed only by presenting the Hanamura club card in the restaurant, including pick up orders which are paid in the restaurant. No points can be redeemed without a card or for delivery orders.

Points cannot be transferred or restored in case if the card is lost.

Hanamura does not take any responsibility for the loss of card or points, as the points cannot be reproduced. New card will be issued with 0 points.

Hanamura reserves the right to cease the program without prior notice. In such case, members are entitled to a full reward calculated up to date.

The card can only be used by its registered owner.

Hanamura reserves the right to cancel or suspend the card if the it is used by a different person or is suspected to be operated fraudulently.

Liability

Hanamura’s liability to the extent permitted by law in relation to any product or service purchased as a consequence of using this website is limited to either replacement of any product purchased or the purchase price paid by you to Hanamura for the product or service.

To the extent permitted by law Hanamura will not be liable for any direct, indirect, incidental or consequential damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your access to, or use of, or inability to use this website and the content, whether based on warranty, contract, tort, negligence or any other legal theory, and whether or not Hanamura knows of the possibility of such damage. If a jurisdiction does not allow the exclusion or limitation of liability in accordance with this paragraph but allows a limitation of a certain maximum extent then our liability is limited to that extent.

The website’s content to the extent permitted by law is provided as is and Hanamura makes no representation or warranty of any kind, express or implied, regarding the content or availability of our website, or that it will be timely or error-free, that any errors will be corrected.
